THE ONLINE STORE REGULATIONS
§ 1. General Conditions
1. Nitex-camo.com the Online store (herein after called “the Online store”) is operated by TK Nitex sp. z o.o., seated in Warsaw (00-641), ul. Moktowska 4/6 registered in the Company Register maintained by the District Court for the Capital City of Warsaw in Warsaw, 12th Commercial Division of the National Court Register, under No KRS 0000451382, tax identification number: 7010374013, with share capital of PLN 5,000.00, statistical number: 146600534,Zych@Nitex-camo.com(herein after called „the Seller”).
2. These Regulations apply to the Buyer’s transactions made through the Online store. The Buyers are advised to read these Regulations carefully before ordering any goods or registering. By placing an order or registering the Buyer agrees to be bound by these Regulations.
3. The Buyer may be a natural or legal person or an organizational unit without legal personality granted legal capacity under the applicable law to undertake acts in law pursuant to the applicable legal regulations.
4. The Consumer shall mean a natural person purchasing goods in the Online store pursuant to Article 221 of the Polish Civil Code.
§ 2. Placing an Order
1. The Buyer can place a single order without registering or after registering via their Customer account.
2. Proper order fulfillment requires the Buyer to provide the following details:
a) forename and surname or company name
b) delivery address
c) email address
d) telephone number
e) if required, any other necessary data for invoice to be issued.
Providing the above details is voluntary, however, necessary for proper order fulfillment.
3. Placing an order is available 24 hours a day through the whole calendar year.
§ 3. Conclusion of a Contract and returns
1. All trade information including (but not limited to) prices, advertisements and goods descriptions published at the Online store does not constitute an offer in the meaning of the Polish Civil Code but an invitation to conclude a sale contract.
2. Placement of an order by the Buyer shall be deemed as a purchase offer.
3. Sale contract is concluded when the Seller's Order Acceptance is received by the Buyer, sent by the Seller not later than 48 hours after an order is placed. Should the Seller fail to accept an offer in the abovementioned period, a purchase offer shall be deemed non-binding. For orders placed on Saturdays, Sundays or public holidays, the period of 48 hours shall run from 8 am of the next working day.
4. The Seller confirms the receipt of a purchase offer via email on address provided by the Buyer when placing an order.
5. According to the act of 2 March 2000 on the protection of certain consumer rights and the liability for damage caused by a dangerous product (Official Journal of Laws 2000, No 22, item 271) the Consumer who concluded the distance contract may withdraw from it without giving reasons by way of appropriate written statement, within the period of ten days from the date the goods have been delivered. To meet this term it is sufficient to send the withdrawal statement to Zych@Nitex-camo.com or to the following address:

A withdrawal form is attached to this Regulations as Annex No 1 and is also delivered with
ordered goods.
6. In case of withdrawal, the contract shall be considered null and void and the consumer shall be free from any obligations. What parties rendered each other shall be returned unchanged, unless the change has been necessary under the limits of usual management. Returns shall be made within 14 days from the withdrawal date.
7. Goods returned as a result of a withdrawal shall be complete i.e. with full equipment, documents, labels and its integral accessories and shall not bear any marks of usage beyond scope of ordinary management. Unwanted items should be returned in a re-saleable condition, packed in a way that guaranties undamaged transportation, and, if possible, in its original packaging.
8. Settlement of transactions by credit card and e-transfer is carried out Dotpay and PayPal.
§ 4. Payment
1. Prices in the Online store are expressed in Euro and include all Polish taxes (including VAT).
2. Prices do not include delivery cost. The Buyer is expressly informed about delivery cost during each order placement through the shopping system.
3. The amounts due for the goods and delivery shall be paid by one of the following ways:
a) Cash upon delivery
b) Bank transfer, to the Seller’s bank account:

c) Online payment system via dotpay.pl and PayPal.
4. The payment is deemed to be made when the Seller’s bank account has been credited or when the positive payment authorization from online payment system has been received.
5. The Seller reserves the right to allow payment to be made by another payment method individually and if previously agreed with the Buyer.
6. The Seller reserves the right to collect an additional payment related to a payment method chosen by the Buyer. In this case, the Buyer will be expressly informed about any additional payment before an order is placed.
7. All prices and promotions are subject to availability and may be withdrawn or amended at the Seller’s discretion. Prices and promotions may vary and may only be available for limited periods. The Seller reserves the right to introduce new products, and to remove unavailable products.
§ 5. Delivery
1. The Buyer commences realization of an order without delay immediately after the payment has been made. In case of cash on delivery payment method the Buyer commences realization of an order as soon as the Order Acceptance is provided. Goods are shipped within 24 hours after payment
2. The ordered goods shall be sent within 24 hours from the commencement of the order realization.
3. The ordered goods are delivered to the Buyer’s address provided at the time of order placement.
4. Deliveries are made by a courier firm.
5. The ordered goods are delivered to the Buyer with the sales documents, i.e. invoice or fiscal receipt - if the Buyer required thereof at the time of placing an order.
§ 6. Complaints
1. According to the act of 27 July 2002 on specific terms and conditions of consumer sale and amendments to the Civil Code (Official Journal of Laws 2002, No 141, item 1176 as amended) the Seller shall be liable towards Buyer the for inconsistency of goods with the contract.
2. Provided a producer issued a producer guarantee for his products, the Buyer may as well exercise rights granted thereunder.
3. The Buyer who is not the Consumer is entitled to exercise rights under statutory warranty pursuant to the act of 23 April 1964 Polish Civil Code (Official Journal of Laws 1964, No 16, item 93 as amended).
§ 7.Final Provisions
1. To all matters not settled herein provisions (in particular) of the act of 23 April 1964 Polish Civil Code (Official Journal of Laws 1964, No 16, item 93 as amended), the act of 27 July 2002 on specific terms and conditions of consumer sale and amendments to the Civil Code (Official Journal of Laws 2002, No 141, item 1176 as amended), act of 2 March 2000 on the protection of certain consumer rights and the liability for damage caused by a dangerous product (Official Journal of Laws 2000, No 22, item 271 as amended) shall apply.
2. Nothing in these terms is intended to affect in any way the Buyer binding statutory rights.
3. The Seller exercises all reasonable efforts, the published pictures show the highest quality and reflect the actual condition and colours of the presented products to the highest possible extent.
4. All published on the Online store trademarks, names and any other objects that might be a subject to intellectual property rights are used for identification purposes only, and may be a property of their lawful owners.
5. By placing an order the Buyer agrees to have its personal data processed according to the provisions of the act of 28 August 1997 on the personal data protection (Official Journal of Laws 1997, No 133, item 883 as amended). The buyer is entitled to have an access to the data, to complete, to temporarily or permanently suspend the processing of the data, as well as the right to request to have the data erased from the database.
6. The Seller shall process the personal data of the Buyer only for the purposes of proper realization of an order, performance of a contract and delivery.
7. Upon the consent of the Buyer, the Seller may process their personal data for informational and marketing purposes including subscription to a newsletter.
8. The Seller reserves the right to amend these Regulations. Amendments shall come into force on the fifteenth day after their publication. The provisions of these Regulations apply to the orders placed prior to the planned amendments.
9. These Regulations shall come into force on 19.09.2013.
